Please read these terms and conditions of use carefully before using any materials, information or services. By accessing www.gaiahotel.ch you agree to accept, without limitation or qualification, all of these terms and conditions of use.

Ownership

www.gaiahotel.ch offers information on the GAIA HOTEL, which is managed and operated by the GAIA Hotel AG (collectively, "we" or "us"). Access to and use of the website is subject to any specific terms and conditions set forth on the individual pages within the website and these terms and conditions of use (collectively, the "terms"). We reserve the right at any time to change any of the terms and conditions contained herein or any information contained in the websites. By using the websites, you agree in advance to accept any such changes.

Privacy

Your use of the website is subject to the following privacy policy of the GAIA Hotel AG.

Use of www.gaiahotel.ch

You may only use the websites if you are at least 18 years of age. You are responsible for maintaining the secrecy of your passwords, login and account information. You will be financially accountable for all uses of the websites by you and anyone using your password and login information. You may only use the websites to make legitimate reservations. You may not use the websites: to make any false, fraudulent or speculative reservation or any reservation in anticipation of demand; to post or transmit any unlawful, threatening, obscene, indecent or pornographic material or any material that could constitute or encourage conduct that would be considered a criminal offence or otherwise violate any law. We may, at any time and without advance notice or liability, terminate or restrict your access to all or any component of the websites.

Promotional Information

We may make information regarding specific offers, which we are conducting, available on the websites. Any such offer is subject to the specific terms, conditions and restrictions listed on the websites in connection with such an offer. We reserve the right to alter or withdraw any offer or at any time.

BeRest Restaurant Vouchers

Vouchers can only be redeemed in their entirety and any difference cannot be paid out in cash. If there is any difference in your favour, you are free to use the value voucher. Availability

The websites are available worldwide to anyone with Internet access. However, the websites may not be continuously available due to maintenance or repairs or due to computer problems or crashes, disruption in internet service or other unforeseen circumstances.

General

The terms apply to your use of the websites, including all transactions you effect through the websites. The terms, together with the www.gaiahotel.ch privacy policy and the items made a part of these terms by reference, make up the entire agreement between us relating to your use of the websites, and replaces any prior understandings or agreements (whether oral or written) regarding your use of the websites.

Links

We do not review or monitor any websites linked to the website and are not responsible for the content of any such linked websites. In addition, you agree not to link your website or any other third party website to the websites without our prior written consent.

Limitation of Liability

Neither we nor any of our representatives shall be liable to you or anyone else for any loss or injury or any direct, indirect, consequential or similar damages arising out of your access or use of, or your inability to access or use, the websites or any materials, opinions or recommendations of third parties on the websites. You hereby waive any and all claims against us and our representatives arising out of your use of the websites or any materials, opinions or recommendations of third parties on the websites.

Best Price Guarantee

We guarantee you the best price when you book a room directly through us: If you find a cheaper, publicly available rate on another site within 24 hours of making your booking, we will refund you the difference upon check-out.

Our Best Rate Guarantee does not apply to the following

• Reservations booked on websites other than the GAIA HOTEL
• Hotel packages or travel packages that may include hotel, airfare, car rental, food and beverage offers or other similar packages or amenities
• Discount or negotiated rates not available to the general public, including but not limited to membership rates, corporate, government, promotional, unpublished, packaged or opaque rates, group or other specially negotiated rates or rates available on closed membership sites
• Reservations made within 24 hours of arrival
• Taxes, gratuities, service charges, early departure fees or other fees and incidental charges
• Rate disparities due to fluctuations, rounding or differences in currency exchange rates

Non-smoking rooms

It is prohibited to smoke in the room. We kindly ask our guests to smoke outside the hotel. Guests, who smoke in their room are charged a cleaning fee of CHF 200.

Check-in and Check out

Check-in time starts from 3 p.m. Check out time is at 12 p.m.

Breakfast Buffet

In Breakfast is being served Monday through Thursday from 6:30 until 10:00 a.m. and Friday through Sunday from 07:00 until 12:00 a.m. Unless otherwise stated, the breakfast is included in the overnight price.

Children

Baby cots are free of charge but must be reserved by email 24 hours before arrival. Children under 12 years old (up to 11.99 years old) stay free of charge when accompanied by an adult. An extra bed in the parents' room for children over 12 years old is charged at CHF 100.00 per bed/night.

Pets

Bringing a pet requires the consent of the GAIA HOTEL. The guest is obliged to notify GAIA HOTEL in advance of the wish to bring a pet. If GAIA HOTEL agrees to the bringing of a pet, this shall be on the condition that the pet is under the constant supervision of the guest, is free from disease and does not otherwise pose a danger to the hotel guests or staff. It is not permitted to bring the pet with you to breakfast or in the public or gastronomic areas of the GAIA HOTELs. A fee of CHF 15.00 per night will be charged for the pet. Exceptions are guide dogs, deaf dogs and other comparable service dogs. These may be brought along free of charge and at any time.

Prepayment and Rates

All rates are quoted per room and per night. They include an abundant breakfast buffet, service and VAT. The city tax of CHF 4.00 is added per person and per night. Breakfast is being served daily in the banqueting room, unless requested to be brought to the hotel room. A credit card guarantee is required for all reservations. The amount of one overnight stay will be reserved in order to verify the credit card. Invoices are only forwarded to exclusive business partners. We reserve the right at any time to ask for a prepayment for any reservation or change any rates quoted in the websites.

Prices and payment methods

All prices quoted in price lists, on websites or elsewhere are in Swiss francs and include statutory VAT. The prices result from the conclusion of the contract or the underlying price list. Changes to bookings entitle GAIA HOTEL to request different prices, e.g. change the number of rooms booked or the length of stay of the guests. The prices exclude city tax of CHF 4.00 per person and night.

Please note: Our payment processor is based in the Netherlands, so additional fees may apply depending on the financial service provider you use.

Cancellation Policies

Fully flexible rates can be cancelled up to 2PM on the day of arrival. Late cancellations will incur a one night cancellation fee (100%). A valid credit card is required. Non-refundable rates cannot be cancelled. Again, a valid credit card is required.

Group reservations can be cancelled up to 30 days prior to arrival free of charge. 29-08 days prior to arrival, 50% of the reservation will be charged. 07 days prior to arrival, 100% of the reservation will be charged.

Cancellation and No-Show

Cancellations should take place in accordance with the cancellation policy of the booked rate, otherwise, a cancellation fee is charged in the amount of one overnight stay (100%). By confirming your reservation, you agree in advance to unconditionally accept these terms unless otherwise agreed upon. If you do not sign the confirmation, your booking will be cancelled automatically.

Number of Participants and List of Names

The event planer or organizer must submit the definite and binding number of participants to the GAIA HOTEL no later than 2 workdays prior to the convention or date of arrival.

Valuables

Neither we nor any of our representatives shall be liable to you or anyone else for any loss or theft. Valuables must be secured in the hotel safe.

Governing Law and Choice of Forum

These terms and conditions of use and any disputes arising out of or related to the websites or use of the websites, shall be governed by, construed and enforced in accordance with, the laws of the canton of Basel-City, without regard to its conflict of laws rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these terms and conditions of use or your use of this website shall be filed only in the canton’s court located in the canton of Basel-City. Any communication or material transmitted to us via the websites or internet e-mail is transmitted on a non-confidential basis.
